• Submit a signed hard copy and an identical electronic copy via the eThekwini Municipality JDE System (ESP Module).
• Hard copy must be sealed, addressed to the City Manager, marked with Tender Number 35073-1M, and placed in the Tender Box at ground floor foyer, Municipal Buildings, 166 KE Masinga Road (Old Fort Rd), Durban.
• Electronic submission alone is insufficient; the hard copy is the ruling version and must be submitted for the tender to be valid.
• Closing date: Friday, 21 August 2026 at 11:00am. Late submissions will not be accepted.
• Facsimile, email, or posted tenders will not be accepted.
• Required returnable documents include: Authority of Signatory, Tax Compliance Status PIN/Tax Clearance Certificate, Declaration of Municipal Fees, Declaration for Occupational Health and Safety Act, MBD 4, MBD 5, MBD 6.1, MBD 8, MBD 9, and Official Tender Form.
• Tenderers must be registered on the National Treasury Central Supplier Database (CSD) and provide their CSD Supplier Number (starting with 'MAAA').
• Tenderers must also register on the eThekwini Municipality’s supplier database via https://ethekwinivendor.durban.gov.za/.
• Failure to include required documents or comply with submission instructions may result in disqualification.

Registration on National Treasury Central Supplier Database (CSD) is mandatory for all tenderers (and each JV partner). Tenderers must not be 'persons in the service of the state' as defined. Municipal fees must be paid or under acknowledgment of debt. VAT registration status must be declared. A non-refundable R6,131 fee is required for objections.

• Scope: Manufacture, supply, and delivery of polymer concrete products and compression moulded products for a 36-month period.
• Tenderer must be either a manufacturer or an accredited service provider of the manufacturer of the polymer/concrete products offered.
• Manufacturers must provide specified SANS standards.
• Accredited service providers must submit a supplier agreement from the manufacturer accompanied by the specified SANS standards (in the name of the manufacturer).
• A valid SANS 1882 (2003) certificate must be submitted with the tender.
• Bidders may be required to state where samples can be inspected or submit samples for inspection prior to the closing date.
• Names of manufacturers of goods offered must be stated in the tender.
• Non-manufacturers must provide a valid agreement/Joint Venture Agreement with the manufacturer, accredited distributor, or agent, covering the contract period.
• Delivery, risk, and packaging: Goods supplied against official order; unit price includes delivery to specified point; risk remains with supplier until delivery; delivery period after order receipt must be stated.

• Bidders may be required to submit samples or state where samples can be inspected prior to closing date.
• Manufacturers' names for goods offered must be stated.
• Non-manufacturers must provide valid agreement/Joint Venture Agreement with manufacturer, accredited distributor, or agent covering contract period.
• Goods supplied only against official municipality order.
• Risk in goods remains with supplier until duly delivered.

• Bill of Quantities/Schedule of Rates/Activities is provided in Section 8 of the tender document.
• Estimated quantities are for information only; supplier must supply actual quantities ordered.
• Pricing must be on Official Tender Form; deviations may lead to disqualification.
• Unit prices must include delivery to specified point.
• Firm prices may be quoted for 12-month periods, free from fluctuations.

• Prices must be quoted in South African Rand (ZAR), net of brokerage or discount.
• Prices exclusive and inclusive of VAT must be stated separately on the Official Tender Form.
• Bidders may submit firm prices for each 12-month period, free from fluctuations including statutory increases.
• Pricing structure must not deviate from the Official Tender Form; deviations may preclude the bidder.
• Estimated quantities are provided in Section 8 (Bill of Quantities/Schedule of Rates) for information only; supplier is bound to supply actual quantities required by the municipality.
• Payment terms are as per the Conditions of Contract; payment made only to the supplier(s); factoring arrangements not accepted.
• The municipality does not bind itself to a minimum quantity per order.

• Mandatory registration on the National Treasury Central Supplier Database (CSD). Provide CSD Supplier Number (MAAA) in Section 1.
• Submit a valid Tax Compliance Status PIN (TCS PIN) or original Tax Clearance Certificate with sufficient validity. Separate TCS PINs required for each entity in a Joint Venture.
• Declaration of Municipal Fees: Confirm municipal fees are paid or an acknowledgement of debt agreement is in place. Include relevant account numbers.
• Submit required MBD forms: MBD 4 (Declaration of Interest), MBD 5 (Declaration for Procurement Above R10 Million), MBD 6.1 (Preference Points Claim), MBD 8 (Declaration of Bidder’s Past SCM Practices), MBD 9 (Certificate of Independent Bid Determination).
• Declaration with respect to the Occupational Health and Safety Act: Accept undertaking and provide a documented Health and Safety Plan.
• B-BBEE: Preference points claimed via MBD 6.1; proof may include CIPC registration, CSD report, B-BBEE Certificate, or consolidated certificate for consortia/JVs.
• Joint Venture bidders must include an acceptable Joint Venture Agreement and a B-BBEE Certificate for the Joint Venture.
• Persons in the service of the state (as per Regulation 44) are not eligible to tender.

• Compliance with the Occupational Health and Safety Act and relevant Regulations is required.
• Tenderer must submit a Declaration with respect to the Occupational Health and Safety Act.
• Tenderer must undertake to perform work/supply/services in compliance with the Act and the municipality's Health and Safety Specifications.
• A documented Health and Safety Plan must be submitted and is subject to approval by the municipality.
• Tenderer is liable for penalties for non-compliance.

• Contract governed by Standard Conditions of Tender (Goods/Services), Special Conditions of Tender (SCT), General Conditions of Contract (GCC) (National Treasury Circular 52, July 2010), Special Conditions of Contract (SCC), Occupational Health and Safety Act, and eThekwini Code of Conduct.
• Tender validity: 120 days from opening, extendable by 12 months unless bidder advises otherwise.
• Municipality reserves right to cancel tender before award without liability for damages.
• Successful tenderer required to fill in and sign written Contract Form (MBD 7).
• Municipality may negotiate final terms with preferred bidders under Regulation 24 of MFMA, subject to fairness.
• Appeals against decisions must be lodged within 14 days to the City Manager (Ms. S. Pillay) with a non-refundable administration fee of R6,131.00 (including VAT).
• Contract may be terminated if Regulation 44 (persons in service of the state) is breached.
• Change of ownership or major policy during contract period must be disclosed in covering letter with tender.
