✓ The BEC will write final recommendations to NDA’s Bid Adjudication Committee (BAC)

(a) Whilst all due care has been taken in connection with the preparation of this bid, the NDA
makes no representations or warranties that the content in this bid or any information
communicated to or provided to bidders during the bidding process is, or will be, accurate,
current or complete. The NDA and its officers and employees will not be liable for any
information communicated which is not accurate, current or complete.
(b) If a bidder finds or reasonably believes it has found any discrepancy, ambiguity, error or
inconsistency in the bid or any other information provided by the NDA (other than minor
clerical matters); the bidder must promptly notify NDA in writing of such discrepancy,
ambiguity, error or inconsistency to allow the NDA to consider what corrective action is
necessary (if any).
(c) Any actual discrepancy, ambiguity, error or inconsistency in this bid or any other
information provided by the NDA will, if possible, be corrected and provided to all bidders
without attribution to the bidder who provided the written notice.
(d) No representations made by or on behalf of NDA about this bid will be binding on the NDA
unless that representation is expressly incorporated into the contract ultimately entered
between NDA and the successful bidder.

(a) Bids will be evaluated in accordance with the NDA’s Supply Chain Management Policy and
Preferential Procurement Policy, 2023, using the 80/20 preference points system as
prescribed in the Preferential Procurement Policy Framework Act (PPPFA, Act ).
The lowest acceptable bid will score 80 points for price (the lowest acceptable bid will score
80 points and bidders that quoted higher prices will score lower points for price on a pro-
rata basis).
(b) The bid proposals received will be evaluated in Four phases. On the Phase01: bids will be
evaluated on Compliance to SCM Administrative Requirements, Phase 02: Mandatory
Requirements, Phase 03: Technical Evaluation/Functionality (comprising of stage 1 and 2)
and lastly Phase 04: in accordance with the 80/20 preference points system respectively.
(c) Bid proposal must score a minimum of 80 (eighty) points out of 100(hundred)points on
functionality to qualify for advancement to the next phase of evaluation. Last phase (04), a
bid proposal scoring less than 80 points out of 100 will not be considered for further
evaluation and will be disqualified.
(d) Phase 04: During this phase, bid proposals that passed the first phase will be further
evaluated based on the 80/20 preference points system in accordance with the PPPFA Act,
where 80 points will be attained in respect of price (the lowest acceptable bid will score 80
points and bidders that quoted higher prices will score lower points for price on a pro-rata

Social Development. The NDA is classified as a public entity under schedule 3A of the
Public Finance Management Act, 1999 (Act No. ), and was established in
November 1998 by the National Development Act, 1998 (Act No. ) (NDA Act)
as government’s response to the challenge of poverty and its causes in South Africa.
b. The NDA derives its mandate from the National Development Agency Act, 1988 (Act No.
). In terms of the Act, the primary objective of the NDA is to contribute towards
the eradication of poverty and its causes by granting funds to CSOs for the purposes of:
(i) carrying out projects or programmes aimed at meeting the development needs of poor
communities; and
(ii) strengthening the institutional capacity of other CSOs involved in direct service provision
to poor communities.
c. The secondary objects of the NDA in terms of the Act are-
(i) to promote-
(ii) consultation, dialogue and sharing of development experience between CSOs
and relevant organs of State; and
(iii) debate on policy development
(iv) to undertake research and publication aimed at providing the basis for
development policy.
d. The NDA plays a critical role in contributing towards shifting the country from the scourge
of poverty towards poverty eradication. Through the Act and various policies, the NDA
contributes to – but is not limited to – the advancement of economic development, social
cohesion, access to basic human rights and skills development. This contribution of the
NDA supports the National Development Plan (NDP) 2030 outcomes for a greater and
better South Africa.

(a) Bidders must submit a detailed cost breakdown for all applicable costs e.g. Initial setup
costs, monthly costs, and any other applicable costs. All prices submitted must be
inclusive of VAT.
(b) Bidders must indicate if their prices will be fixed and firm for the duration of the proposed
contract period, if not, the proposed escalations should be indicated.
(c) Bidders must ensure that the quotes submitted have no arithmetic errors as NDA will not
rectify any errors and no adjustments to quotations received will be permitted.
(d) Bidders will carry the responsibility of ensuring that the proposals submitted have been
signed by a duly authorised person. Should it be established after the submission of
proposals that the signatory authorising the proposal is not legally appointed by the
service provider, the offer/proposal will be disqualified from the evaluation process.
(e) All prices submitted should be typed in black ink or written in pen, proposals written in
pencil will not be accepted and evaluated.
(f) A two-envelope system will be used for the submission of proposals.

General Conditions of Contract
1.1 “Closing time” means the date and hour specified in the bidding
documents for the receipt of bids.
1.2 “Contract” means the written agreement entered into between
the purchaser and the supplier, as recorded in the contract form
signed by the parties, including all attachments and appendices
thereto and all documents incorporated by reference therein.
1.3 “Contract price” means the price payable to the supplier under
the contract for the full and proper performance of his
contractual obligations.
1.4 “Corrupt practice” means the offering, giving, receiving, or
soliciting of any thing of value to influence the action of a public
official in the procurement process or in contract execution.
1.5 "Countervailing duties" are imposed in cases where an
enterprise abroad is subsidized by its government and
encouraged to market its products internationally.
1.6 “Country of origin” means the place where the goods were
mined, grown or produced or from which the services are
supplied. Goods are produced when, through manufacturing,
processing or substantial and major assembly of components, a
commercially recognized new product results that is
substantially different in basic characteristics or in purpose or
utility from its components.
1.7 “Day” means calendar day.
1.8 “Delivery” means delivery in compliance of the conditions of the
contract or order.
1.9 “Delivery ex stock” means immediate delivery directly from stock
actually on hand.
1.10 “Delivery into consignees store or to his site” means delivered
and unloaded in the specified store or depot or on the specified
site in compliance with the conditions of the contract or order,
the supplier bearing all risks and charges involved until the
supplies are so delivered and a valid receipt is obtained.
1.11 "Dumping" occurs when a private enterprise abroad market its
goods on own initiative in the RSA at lower prices than that of
the country of origin and which have the potential to harm the
local industries in the RSA.
1.12 ”Force majeure” means an event beyond the control of the
supplier and not involving the supplier’s fault or negligence and
not foreseeable. Such events may include, but is not restricted
to, acts of the purchaser in its sovereign capacity, wars or

revolutions, fires, floods, epidemics, quarantine restrictions and
freight embargoes.
1.13 “Fraudulent practice” means a misrepresentation of facts in
order to influence a procurement process or the execution of a
contract to the detriment of any bidder, and includes collusive
practice among bidders (prior to or after bid submission)
designed to establish bid prices at artificial non-competitive
levels and to deprive the bidder of the benefits of free and open
competition.
1.14 “GCC” means the General Conditions of Contract.
1.15 “Goods” means all of the equipment, machinery, and/or other
materials that the supplier is required to supply to the purchaser
under the contract.
1.16 “Imported content” means that portion of the bidding price
represented by the cost of components, parts or materials which
have been or are still to be imported (whether by the supplier or
his subcontractors) and which costs are inclusive of the costs
abroad, plus freight and other direct importation costs such as
landing costs, dock dues, import duty, sales duty or other similar
tax or duty at the South African place of entry as well as
transportation and handling charges to the factory in the
Republic where the supplies covered by the bid will be
manufactured.
1.17 “Local content” means that portion of the bidding price which is
not included in the imported content provided that local
manufacture does take place.
1.18 “Manufacture” means the production of products in a factory
using labour, materials, components and machinery and
includes other related value-adding activities.
1.19 “Order” means an official written order issued for the supply of
goods or works or the rendering of a service.
1.20 “Project site,” where applicable, means the place indicated in
bidding documents.
1.21 “Purchaser” means the organization purchasing the goods.
1.22 “Republic” means the Republic of South Africa.
1.23 “SCC” means the Special Conditions of Contract.
1.24 “Services” means those functional services ancillary to the
supply of the goods, such as transportation and any other
incidental services, such as installation, commissioning,
provision of technical assistance, training, catering, gardening,
security, maintenance and other such obligations of the supplier
covered under the contract.

d. The landlord will refurbish the office using the TI amount and there will be no financial
contribution by NDA. The refurbishments will include but not limited to flooring, ceilings,
partitioning, ablutions, paintwork, electrical installations, plumbing, window blinds,
signage and all requirements for the office to be functional.

e. The office building must be located on the ground floor or MUST have an existing
fully functional elevator/lift (if located beyond the ground floor).
f. The office must be fibre ready.
g. Service provider must submit a valid/certified OHS compliance certificate for the proposed
building, approved by any of the following authorising bodies:
o The Municipal Building Control Officer (BCO)
o Municipal Fire Department under the National Building Regulations and
Building Standards Act (Act )
o The Department of Employment & Labour
h. Office provided must have two exit/entry points.
i. The proposed office must have the capacity to provide fully functional and individually
controlled air conditioners for the office. (The office will have 9 occupants).
j. Letter from the architect or any other South African regulatory body confirming that the
building is a grade A or B.
k. Provide confirmation that the bidder has a qualified architectural team that will be available
to engage with NDA at partitioning stage.
l. A valid copy of Property insurance or Insurance certificates must be attached with the
submission.
m. The maintenance of the building including fire extinguishers shall be the responsibility of
the landlord and all logged calls should be responded to within 48 hours.
n. The main entrance to the office must have security gates unless it is not accessible to the
public.
o. Window blinds must be installed on all windows. The colour for the blinds shall be in line
with the NDA corporate ID.
p. Ablution facilities for men, women and for people with disabilities (If the proposed space
currently does not have ablutions for people living with disabilities, a signed letter
confirming that this will be constructed prior to NDA taking occupation, at no charge to the
NDA should be submitted). The ablution facilities must be on the same floor as the offered
office space.
q. Confirmation of parking bays as per table 2.1 above
Note: Confirmation that the above requirements are available MUST be in a signed
letter expressly stating each of the requirements. A one liner letter saying “All these
requirements are available” will not be accepted. Failure to submit confirmation will
result in immediate disqualification.

1.1 “Closing time” means the date and hour specified in the bidding
documents for the receipt of bids.
1.2 “Contract” means the written agreement entered into between
the purchaser and the supplier, as recorded in the contract form
signed by the parties, including all attachments and appendices
thereto and all documents incorporated by reference therein.
1.3 “Contract price” means the price payable to the supplier under
the contract for the full and proper performance of his
contractual obligations.
1.4 “Corrupt practice” means the offering, giving, receiving, or
soliciting of any thing of value to influence the action of a public
official in the procurement process or in contract execution.
1.5 "Countervailing duties" are imposed in cases where an
enterprise abroad is subsidized by its government and
encouraged to market its products internationally.
1.6 “Country of origin” means the place where the goods were
mined, grown or produced or from which the services are
supplied. Goods are produced when, through manufacturing,
processing or substantial and major assembly of components, a
commercially recognized new product results that is
substantially different in basic characteristics or in purpose or
utility from its components.
1.7 “Day” means calendar day.
1.8 “Delivery” means delivery in compliance of the conditions of the
contract or order.
1.9 “Delivery ex stock” means immediate delivery directly from stock
actually on hand.
1.10 “Delivery into consignees store or to his site” means delivered
and unloaded in the specified store or depot or on the specified
site in compliance with the conditions of the contract or order,
the supplier bearing all risks and charges involved until the
supplies are so delivered and a valid receipt is obtained.
1.11 "Dumping" occurs when a private enterprise abroad market its
goods on own initiative in the RSA at lower prices than that of
the country of origin and which have the potential to harm the

1.12 ”Force majeure” means an event beyond the control of the
